Foxconn has started shipping the highly anticipated iPad 3 ahead of Apple's official unveiling of the tablet in March, according to MacRumors, which came across a shipping document on a Chinese Web site.

The document on the Twitter-like Web site Sina Weibo shows details of shipments beginning Sunday from Apple supplier Foxconn to the United States.

A translation of the document by MacRumors indicates that the tablet will ship into three major U.S. airports with maximum cargo security and initial deliveries will begin March 9.? MacRumors has also released a picture of the tablet being uploaded onto a plane.

With just weeks left until Apple's anticipated official unveiling of the iPad 3, a Chinese blog claims to have leaked pictures of the next-generation tablet.

The?Apple Daily?has published unconfirmed pictures of an iPad 3 that looks much like the iPad 2. The pictures show the tapered back of the tablet and parts of its apparent inner mechanisms.

The?Chinese blog?claims to have discovered an Apple A6 chip, which is the prime rumored processor of the iPad 3. It also says the new iPad will come with 4G connectivity as opposed to 3G found in the iPad 2.

Judge awards iPhone user $850 in throttling case

SIMI VALLEY, Calif. (AP) ? When AT&T started slowing down the data service for his iPhone, Matt Spaccarelli, an unemployed truck driver and student, took the country's largest telecommunications company to small claims court. And won.

His award: $850.

Pro-tem Judge Russell Nadel found in favor of Spaccarelli in Ventura Superior Court in Simi Valley on Friday, saying it wasn't fair for the company to purposely slow down his iPhone, when it had sold him an "unlimited data" plan.

Spaccarelli could have many imitators. AT&T has some 17 million customers with "unlimited data" plans who can be subject to throttling. That's nearly half of its smartphone users. AT&T forbids them from consolidating their claims into a class action or taking them to a jury trial. That leaves small claims actions and arbitration.

Late last year, AT&T started slowing down data service for the top 5 percent of its smartphone subscribers with "unlimited" plans. It had warned that it would start doing so, but many subscribers have been surprised by how little data use it takes for throttling to kick in ? often less than AT&T provides to those on limited or "tiered" plans.

Spaccarelli said his phone is being throttled after he's used 1.5 gigabytes to 2 gigabytes of data within a new billing cycle. Meanwhile, AT&T provides 3 gigabytes of data to subscribers on a tiered plan that costs the same ? $30 per month.

When slowed down, the phone can still be used for calls and text messaging, but Web browsing is painfully slow, and video streaming doesn't work at all.

AT&T spokesman Marty Richter said the company will appeal the judge's ruling.

"At the end of the day, our contract governs our relationship with our customers," he said.

AT&T area sales manager Peter Hartlove, who represented the company before Nadel, declined to comment on the ruling. He argued in court that his employer has the right to modify or cancel customers' contracts if their data usage adversely affects the network.

Companies with as many potentially aggrieved customers as AT&T usually brace themselves for a class-action lawsuit. But last year, the Supreme Court upheld a clause in the Dallas-based company's subscriber contract that prohibits customers from taking their complaints to class actions or jury trials.

Arbitration and small-claims court cases are cheaper and faster than jury trials, but they force plaintiffs to appear in person and prepare their own statements. In a class-action suit, the work can be handled by one law firm on behalf of millions of people.

That means thousands ? and possibly hundreds of thousands ? of people who feel abused by AT&T's policy could seek to challenge the company, one by one, in arbitration or small claims court. The customer contract specifies that those who win an award from the company in arbitration that is greater than the company's pre-arbitration settlement offer will get at least $10,000. Spaccarelli picked the same amount for his claim, though AT&T's stipulation about a minimum award doesn't apply in small claims.

Nadel looked instead at the remaining 10 months in Spaccarelli's two-year contract with AT&T and estimated that he might pay $85 a month on average for using additional data. AT&T charges $10 for every extra gigabyte over 3 gigabytes.

Nadel said it's not fair for AT&T to make a promise to Spaccarelli when he buys the phone while burying terms in his contract that give the company the right to cut down data speeds.

Spaccarelli, 39, researched his case for a few months, and then spent three days putting together a binder of documents to bring to court.

"I need the money, but for me, this case is not about money at all," Spaccarelli. "You don't tell somebody 'you have unlimited' and then cut them off."

Spaccarelli didn't quite uphold his side of the customer contract, and that's one reason his data usage was high. He used the iPhone to provide a link to the Internet for his iPad tablet, a setup known as "tethering." AT&T doesn't allow tethering unless customers pay extra for it, which Spaccarelli didn't do. It detected his tethering last year, and switched him from the "unlimited" plan to a limited one. He complained, and got his "unlimited" plan reinstated.

Even with the tethering, Spaccarelli's data usage wasn't excessive, he said ? about 5 gigabytes per month. AT&T's Hartlove told Nadel about the tethering, and Spaccarelli admitted to it.

Earlier this month, a Southern California woman won a small-claims action against Honda over the gas mileage she got out of her Civic hybrid car. She was awarded $9,867. Meanwhile, a pending class action against Honda over the same issue would net Civic owners a few hundred dollars each. The plaintiff, Heather Peters, is an ex-lawyer who had opted out of the settlement.

AT&T's throttling of "unlimited" data comes as it tries to deal with limited capacity on its wireless network. When the iPhone was new, AT&T had ample capacity on its network, and wanted to lure customers with the peace of mind offered by unlimited plans. Now, a majority of AT&T subscribers on contract-based plans have smartphones, and the proportion is growing every month. That's putting a big load on AT&T's network.

Verizon Wireless and T-Mobile USA also throttle users, but their policies are gentler. Verizon only throttles if the specific cell tower a "heavy user" subscriber's phone is communicating with is congested at that moment. T-Mobile's throttling levels are higher for the same price, and the levels are spelled out ahead of time. AT&T subscribers have no way of knowing if they'll be throttled before a warning message drops in. If they keep using their phones, throttling kicks in a few days later.

World News - Taliban to Afghans: Kill foreigners over Quran burnings

At least six people have been killed amid ongoing violence over the improper disposal of Qurans at NATO's main base in Afghanistan.

KABUL, Afghanistan -- The Taliban urged Afghans Thursday to target foreign military bases and kill Westerners in retaliation for burnings of copies of the Quran at NATO's main base in the country as a third day of violent?protests began.

Thousands of demonstrators gathered across the country, some chanting "Death to America!", Reuters witnesses and officials said. In eastern Kabul, hundreds of youths threw rocks at police, who fired shots into the air to try disperse the crowds.

"Our brave people must target the military bases of invader forces, their military convoys and their invader bases," read an emailed Taliban statement released by the insurgency's spokesman Zabihullah Mujahid. "They have to kill them (Westerners), beat them and capture them to give them a lesson to never dare desecrate the holy Quran again."

Report: 2 NATO troops slain by soldier angry 'over Quran burning'

However, provincial officials and police said Thursday that there were peaceful demonstrations in three eastern provinces to vent anger over the Quran burnings.

More than 2,000 people turned out at the biggest demonstration in the capital of eastern Laghman province, officials and police said.

Thousands of Afghans protested against the unintentional burning of Qurans and other Islamic religious materials during trash disposal at an American air base. ?NBC's Atia Abawi reports.

About 500 people protested in the Khoshi district of Logar province and the rally ended without incident. Hundreds also protested in the eastern city of Jalalabad.

On Wednesday, seven people were killed in clashes between Afghan security forces and protesters demonstrating over the Quran burnings.

'Take up jihad'
Most Westerners were already confined to their heavily fortified compounds, including within the sprawling U.S. Embassy complex and nearby embassies in central Kabul.

The Quran burnings could make it even more difficult for U.S.-led NATO forces to win the hearts and minds of Afghans and bring the Taliban to the negotiating table ahead of the withdrawal of foreign combat troops by the end of 2014.

Muslims consider the Quran the literal word of God and treat each book with deep reverence. Desecration is considered one of the worst forms of blasphemy.

PhotoBlog: Protests spread amid Afghan fury at Quran burning

Large protests erupted in eastern Laghman province and the eastern city of Jalalabad, despite an appeal by President Hamid Karzai on Wednesday for calm after officials said six people were shot dead and dozens wounded in demonstrations.

Protests also kicked off in the relatively stable northern provinces of Badakhshan and Takhar on the border with Tajikistan, as well as nearby Baghlan province

The fury could complicate efforts by U.S. and NATO forces to reach agreement on a strategic pact currently under consideration with the Afghan government that would allow a sharply reduced number of western troops in the country well beyond their combat exit deadline of end-2014.

More than a decade after the beginning of the war, Afghanistan faces external pressure to reform as well as ongoing internal conflicts.

Underscoring these concerns, hundreds of students in Jalalabad rejected any strategic pact with the United States, saying they would "take up jihad" if one was sealed.

In the Khoshi district of eastern Logar province, around some 500 protesters rejected any strategic deal, while in restive Khost province hundreds more chanted "death to America" and "we don't want Americans in Afghanistan".

Apology
The U.S. government and the American commander of NATO-led forces in Afghanistan apologized for "unintentional" burnings after Afghan laborers found charred copies of the Koran while collecting rubbish at the huge Bagram Airbase, about an hour's drive north of Kabul.

A report into the incident by NATO investigators and a team of senior Afghan clerics was to be handed to Karzai as soon as Thursday, making clear how the burning happened.

Findings in NATO Quran burning probe due soon

Martine van Bijlert, from the respected Afghanistan Analysts Network (AAN), said the demonstrations were a combination of religious outrage, pent-up frustration over economic and security conditions, and groups wanting to stir trouble.

"There have been different kinds of outrage. One is the bewilderment felt by many Afghans, and foreigners, that after ten years of efforts in Afghanistan there was apparently still no understanding of how inflammatory mistakes like that are made," van Bijlert said on the AAN website.

"Second, there is the pent-up anger and frustration, with the international military, but also with life in general."

An explosion in space first seen in the 19th century was apparently colder than before thought, throwing a new mystery into what may have triggered it, researchers say.

The cosmic eruption came from?Eta Carinae, a star about 7,500 light-years away from Earth that is one of the most massive stars in our Milky Way galaxy. The star later dimmed, and is now not even in the top 100 list of brightest stars.

Scientists have found that Eta Carinae is a kind of star known as a luminous blue variable, meaning it goes through episodes of dimness and brightness. These rises and falls in luminosity are caused by mounting instability within the star followed by a dramatic loss of mass. The?Great Eruption of Eta Carinae?was an especially catastrophic event, where the star ? once about 140 times the mass of the sun ? lost mass equal to about 20 times that of the sun.

Scientists believed this rare kind of eruption was caused by a stellar wind blowing off the stars. Still, much remained uncertain, since a key detail about the Great Eruption was missing ? its pattern of light. For instance, "cool objects emit redder light than hot objects," Rest explained. "Look at an ember ? if it is relatively cool, it is dark red, and the hotter it gets, the bluer, whiter it gets. So overall the color of the spectra gives you already a good idea how hot or cold the star is."

Now, using the Magellan and du Pont telescopes at Las Campanas Observatories in Chile, Rest and his colleagues have discovered spectra from the Great Eruption, by looking for light from the explosion that bounced or echoed off interstellar dust tens of light-years from the star.

"The missing piece, the big gap, has been that there were no spectra of the Great Eruption," Rest said. "Now we have it, and it gives us the chance to better understand how this eruption happened and what caused it."

Bobby Brown may not attend Whitney Houston?s funeral after all.

While sources have been speculating as to whether?the singer's former husband?would even be welcomed by her family, Fox News is now reporting that Brown will skip the event and instead perform a concert with his former boy band, New Edition, at the Mohegan Sun Arena in Connecticut.

Mohegan Sun Arena confirmed to TODAY.com that as of Thursday afternoon, New Edition?was still scheduled to perform Saturday night, but arena representatives said they did not know if Brown would be part of the concert. ABC News Radio has reported that he will be.

It's possible that he could still attend the noon funeral and make it to the 8 p.m. concert, which is three hours away from the funeral site in Newark, N.J.

The show is part of the group?s reunion tour. Brown?pulled out of concerts?earlier in the week to be with?daughter Bobbi Kristina.

Earlier in the week, a source close to Brown told ABC Newsthat reports by TMZ that?the singer was being "frozen out" by his ex-wife's family were inaccurate.

Brown's rep?told?ABC, "Any report or statement that does not originate from my office about Bobby Brown or his representatives, is not authorized by Bobby Brown. We are not focused on reports, stories or false reports for that matter."

Brown and Houston wed in 1993 and had daughter Bobbi Kristina in 1993. They divorced in 2006.

Houston's funeral will take place at Newark's New Hope Baptist, the church where Houston sang as a girl.

On Thursday, People.com announced that Kevin Costner will speak at the service. The actor, 57, starred with the singer in her movie debut, 1992's ?The Bodyguard.?

Costner played a secret service agent protecting Houston?s character in the movie, and handpicked the singer for the part. He has yet to release a statement surrounding the matter, but?according to a Yahoo! report,?sent flowers to her daughter.

He joins a growing cast of famous friends, including Houston's godmother Aretha Franklin, Stevie Wonder, and Clive Davis, who will remember Houston at the private memorial.

Man who warned of Challenger disaster dies at 73

NEPHI, Utah (AP) ? Roger Boisjoly, a NASA contractor who repeatedly voiced concerns about the space shuttle Challenger before it exploded, has died. He was 73.

Boisjoly died of cancer on Jan. 6 in Nephi, about 40 miles south of Provo, his wife Roberta Boisjoly said.

The 1986 Challenger tragedy shocked the nation. Seven astronauts, including a schoolteacher, were killed when the shuttle disintegrated 73 seconds after liftoff from Cape Canaveral, Fla.

Boisjoly, an engineer at rocket-builder Morton Thiokol Inc., warned in 1985 that seals on the booster rocket joints could fail in freezing temperatures.

"The result would be a catastrophe of the highest order ? loss of human life," he wrote in a memo.

On the eve of the ill-fated flight, Boisjoly and several colleagues reiterated their concerns and argued against launching because of predicted cold weather at the Kennedy Space Center. They were overruled by Morton Thiokol managers, who gave NASA the green light.

Slow-motion video of the launch showed a tongue of flame sprouting from one of the shuttle's solid rocket boosters, licking the main fuel tank.

After the accident, Boisjoly testified to a presidential commission investigating the Challenger accident. The group determined that hot gases leaked through a joint in one of the booster rockets shortly after blastoff that ended with the explosion of the shuttle's hydrogen fuel.

Boisjoly said he was shunned by colleagues and neighbors after emerging as a whistleblower. He took an extended leave of absence while Morton Thiokol worked on a redesign of the rocket joint.

"When I realized what was happening, it absolutely destroyed me," Boisjoly told The Associated Press in a 1988 telephone interview. "It destroyed my career, my life, everything else. I'm just now getting back to the point where I think I'll be able to work as an engineer again."

Boisjoly toured the country and spoke about his experience. He received awards from the American Association for the Advancement of Science and the Institute of Electrical and Electronic Engineers for trying to halt the Challenger launch.

Roberta Boisjoly said her husband continued to receive emails from students and others about his role.

"I'm very proud of what he did. It took a lot of courage," she said. "That's who he was. He would do it again."

Roger Boisjoly was born on April 25, 1938, in Lowell, Mass. He received a degree in mechanical engineering from University of Lowell and was active in the Church of Jesus Christ of LatterDay Saints.

After 27 years as an aerospace engineer, Boisjoly launched his own business in forensic engineering and lectured at universities.

He is survived by his wife of 49 years, two daughters and eight grandchildren.

Risk of Death From Certain Breast Cancers May Rise With Age (HealthDay)

TUESDAY, Feb. 7 (HealthDay News) -- The risk of dying from a hormone receptor-positive breast cancer increases with age, according to new research. And one reason might be that older women with breast cancer are undertreated compared to their younger peers.

For women between the ages of 65 and 74, the risk of dying from breast cancer was 25 percent higher than for women under 65. For those 75 and older, the risk of death was 63 percent higher than for women under 65, according to the new study.

"This study showed that among postmenopausal, non-metastatic, breast cancer patients, elderly patients have a higher risk of dying from breast cancer than younger patients," said study author Dr. Cornelis van de Velde, a professor of surgery at Leiden University Medical Center in the Netherlands and president of the European Cancer Organization.

Results of the study are published in the Feb. 8 issue of the Journal of the American Medical Association.

Breast cancer affects about 226,000 American women every year, according to the American Cancer Society. Worldwide, there were nearly 1.4 million new cases in 2008, according to background information in the study.

Breast cancer tumors can be either hormone receptor-negative or positive. If a tumor is hormone receptor-positive, that means that the tumor's growth is fueled by hormones, such as estrogen, progesterone or both. Certain treatments specifically target hormone receptor-positive cancers.

In the current study, researchers reviewed data from a previous trial of treatments designed for hormone receptor-positive breast cancers. The nearly 10,000 women included were randomly assigned to receive one of two drugs, exemestane (Aromasin) or tamoxifen (Nolvadex), for 2.5 to 3 years, and then all received Aromasin for an additional 2 to 2.5 years. The women were from nine different countries, and all had hormone receptor-positive breast cancer.

There were more than 5,300 women under age 65 in the study; over 3,000 women between the ages of 65 and 74; and just over 1,350 women above the age of 75.

Not unexpectedly, the overall risk of death from any cause was higher for older women. As women aged, the proportion of all-cause deaths attributed to breast cancer became smaller.

However, when the researchers looked at breast cancer-specific deaths, they found that older women were significantly more likely to die from breast cancer than younger women. The investigators also found that for every 10-year increase in age, the risk of death from breast cancer went up by 20 percent.

Van de Velde said the current study can't answer the reason why older women have a higher risk of death from breast cancer, but that "the most plausible explanation is that elderly patients may experience undertreatment."

Len Lichtenfeld, deputy chief medical officer at the American Cancer Society, commented on the findings.

"There has been an assumption that older women may have a more indolent course of breast cancer, and that there was more of a risk of overtreating older women," Lichtenfeld said. "This study suggests that the course of the disease isn't so indolent, and that breast cancer still plays a significant and increasing role in the risk of death in older women."

Lichtenfeld said that while the reasons aren't clear from this study, undertreatment is a possibility. He said there may be a concern about how well older women might handle the side effects of cancer treatments. It's also possible that there's something different in the breast cancer itself that may make it more aggressive, or breast cancers in older women may not respond as well to the available treatments.

Lichtenfeld also noted that other medications older women take could potentially interact with cancer treatments.

The study found that older women tended to have larger tumors at the time of diagnosis, which also could have affected their outcome. But, it wasn't clear if older women had larger tumors when diagnosed because of a lack of screening, or again, if it had something to do with the type of breast cancer they had.

"These data underline the need for age-specific breast cancer studies in order to improve breast cancer outcomes in all ages," van de Velde said.

Funding for the current study was provided by the Dutch Cancer Society. The initial trial received an education grant from Pfizer, the company that manufactures Aromasin.
